The shawaafi” say that based on the ayah he can only marry a slave on the condition of not having Tawl/ability. He says that the status of a child is based on the mom so marrying a slave girl is essentially a way of bringing about more slaves which is looked down upon. Our response is we’re not looking at the consequences/the secondary part of the situation, we’re just looking at the nikaah itself. We’re not enslaving a child either, we’re simply preventing it’s freedom like using protection before relations is not seen as abortion. This is not an aSl issue, this is just a Dimnan issue but it’s not a shari’ee maani’ so it don’t matter.

Y and H say that it is waajib Ala al-fawr because this is similar to a mi’yaar command. It’s only farDh once a year like Sawm, but it’s different since when you miss a fast and make it up it’s considered qaDaa’ while missing hajj for a year and then completing is considered adaa’.
M and SH say that it’s waajib Ala taraakhee because it’s like a Dharf command since if you delay it you’re a faasiq but it is a bit different from DHarf as well since if you delay Salaah you’re not considered faasiq. It’s speculated to have to be delayed for 5 years before the person is considered a faasiq.
