What happens if a cheque is payable to an account holder 'AND' another person?

  • If the account holder wants to deposit the cheque, the other payee must sign the back of the cheque. Authentication of both parties is required.  Standard KYC policy and procedure apply.
  • If the account holder wants to cash the cheque, all payees must sign the back of the cheque.

What do the Access to Funds Requirements cover? 

Under Access to Funds, what is the process for applying access to $100 when depositing multiple cheques ?

Access to Funds you must make available for withdrawal $100.00 per cheque negotiated for Personal Customers. 

This applies to cheques that are drawn on a financial institution located in Canada and issued in Canadian dollars. When a Personal Customer deposits more than 1 cheque in a transaction (either all at once or in separate transactions) you must ensure they receive access to $100 per cheque.

What are the exceptions where Access to Funds do not apply? (5)

  • The account has been opened for less than 90 days.
  • The cheque(s) is double endorsed.
  • The cheque(s) is stale dated.
  • Cheques that are not issued in Canadian dollars.
  • Cheques that are drawn on an institution outside of Canada.
  • You have reasonable grounds to believe the cheque is being deposited for fraudulent purposes.

Under what circumstances and when would you submit an Unusual Transaction Report (UTR)?

You are required to complete an Unusual Transaction Report (UTR) if you have concerns that activity may be potentially related to money laundering or terrorist financing. 

  • In the UTR report, ensure that you accurately describe the scenario and take reasonable measures to identify the individual who conducted the unusual or suspicious transaction.
  • If you are unable to obtain the identification of the individual, do not continue to make attempts to collect it. This may lead to ‘tipping’ the individual.

What is the limit to cash a Federal Government cheque for a customer or noncustomer? And what must non-customer provide for cashing Federal Government cheques? 

TDCT is obligated to cash the item, assuming the item is also $1,750 or less 

Two documents* from a reliable source — one of which indicates the person’s name and address and the other the person’s name and date of birth – see below for list of examples, OR

One piece of identification that is issued by the Government of Canada or the government of a province and that bears the person’s signature and photograph;

Under what scenarios can you refuse to cash a Federal Government Cheque? If you do refuse, what must you provide the customer?

  • The cheque or other payment instrument is for more than $1,750.
  • The Bank has reasonable grounds to believe that there has been illegal or fraudulent activity 
  • The individual is unable to provide identification 
  • There is evidence that the cheque has been altered in any way or is counterfeit.

 If you refuse, you must provide a Letter of Refusal (form 522048).
