Should TK students be suspended?

Willful Defiance: It is illegal in California to suspend any student, from TK all the way through 12th grade, for "disruption or willful defiance" (Education Code 48900(k)).

  • Other Means of Correction: By law (Education Code Section 48900.5), schools must first utilize other means of correction—such as counseling, restorative practices, or parent conferences—before imposing a suspension, unless the offense is severe.
  • Severe Offenses: A suspension can only be issued upon a first offense if the student committed a severe act (e.g., causing physical injury, possessing weapons, or committing sexual assault) or poses a direct threat to others.
