Two boats are sailing towards mark 2 on a standard A course. Both boats are on starboard. Boat Y reaches the 3 boat length zone before an un-overlapped Boat X. Boat Y gybes onto port, but Boat X speeds up and continues close to the mark on starboard. Boat Y hails for mark room, Boat X hails for starboard rights. Boat X gybes inside to avoid contact, but both make contact with no damage done to either. Both hail protest, neither hit the mark. You are the umpire, what is your call?
This is Boat X's foul as Boat Y establishes right to mark room, and according to rules 18.2(a.2), 18.2(b), and 18.4 Boat Y does not forfeit rights to mark room whilst gybing in the zone, and therefore Boat X was not entitled to mark room as this supersedes a port-starboard meeting.
