When is deadly force authorized?

  1. A deputy may use deadly force to protect him/herself or others from what he/she reasonably believes would be an imminent threat of death or great bodily injury (CRS § 18-1-704(2)(a)).
  2. A deputy is justified in using deadly physical force (CRS § 18-1-707(2)(a & b))
    1. To defend him/herself, or another, from what he/she reasonably believes to be the use or imminent use of deadly physical force; or
    2. To effect an arrest, or prevent an escape from custody, if he/she reasonably believes
      1. A subject has committed or attempted to commit a felony with the use or threatened use of a deadly weapon; or
      2. A subject is attempting to escape with the use of a deadly weapon; or
      3. A subject is likely to inflict serious bodily injury or death upon any other person, except through a motor vehicle violation, unless the subject is immediately apprehended.
