What are the facts of the case Marbury v. Madison? 

Marbury was appointed to become a federal district judge. President Adams had appointed this at the very end of his term. Because it was done at the very end of the term the paperwork was not delivered precisely, and Marbury never got his commission. Marbury wanted the executive branch to receive and address his commission. He took this case to the Supreme Court, where Justice John Marshall agreed with his point of view, but did not want to use it because it would make them seem politically against the current presidency. Instead, he decided to address another issue.
