The burden of proof refers to the obligation in a legal case to prove allegations by presenting strong supporting evidence. In a criminal case, the burden rests on the prosecution, in a civil case rests on the plaintiff. In a civil case the party bringing the evidence must only prove there is a preponderance of evidence. Meaning the evidence shows it is more likely than not that the other party is at fault and should be held responsible.

Judicial restrain believes that judicial review should be used sparingly, especially touching on controversial issues. Conservatives much more supportive of this approach.
