The burden of proof refers to the obligation in a legal case to prove allegations by presenting strong supporting evidence. In a criminal case, the burden rests on the prosecution, in a civil case rests on the plaintiff. In a civil case the party bringing the evidence must only prove there is a preponderance of evidence. Meaning the evidence shows it is more likely than not that the other party is at fault and should be held responsible.

What is the difference between judicial restraint and judicial activism 

Judicial activist is based on the belief that the court has the right and obligation to use its power of judicial review to overturn bad precedents and promote socially desirable goals. Liberals tend to support this approach. They look to the court to defend the rights of women and minorities. Judicial restrain believes that judicial review should be used sparingly, especially touching on controversial issues. Conservatives much more supportive of this approach. In Judicial restraint, this approach believes that elected representatives, not unelected judges should make policy issues on things like abortion rights and gay marriage.
