What is a Complaint?

An educator is arrested in another state on two counts of controlled substances. The educator enters a guilty plea under the First Offender Act or a similar adjudication deferral program.

What is a violation?
Any conviction on a felony or misdemeanor involving moral turpitude must be disclosed to the Georgia Professional Standards Commission. A guilty plea or guilty verdict with sentencing under the First Offender Act is still considered a conviction under the statutes pertaining to this agency.

What is not a violation?
The offenses with which the educator was charged are not felonies or misdemeanors involving moral turpitude; therefore, an arrest for those crimes do not have to be reported to the Georgia Professional Standards Commission. However, the educator may still be accountable to the school system for failing to adhere to a local policy regarding reporting.
