What are the two exceptions to arrestees being handcuffed behind their back?
Persons who have been identified, either medically or visually, as being pregnant and upper extremity disabilities (504.10)
•When can you place an inmate into the safety cell? Do you need Supervision approval?
When an inmate exhibits bizarre behavior that results in the destruction of property/cell furnishings, or who reveal an apparent intent to cause injury to themselves, other inmates, or staff; danger to themselves or others; and inmates who have shown apparent intent to harm themselves. Supervision needs to approve all Safety Cell placements. (504.24)
•How often should an inmate in the Emergency Restraint Chair have the wrist straps or handcuffs removed for range of motion? Are there any exceptions?
•Once every thirty minutes, unless a custody supervisor determines that it is unsafe. If removing the wrist straps, handcuffs, or leg restraints poses a danger to the person or staff, the restraints may be left on. This requires a sergeant’s approval and will be documented on the Safety Cell Log. (503.07)
•How old does an arrestee have to be to be booked into the facility with a Juvenile Warrant, no on view charges?
The arrestee is 19 years of age or older and has been arrested for a juvenile court warrant only. (504.13)
When will the Inmates in the sobering cell receive direct visual supervision?
At least once every thirty minutes and documented on the Sobering Cell Log Continuation Sheet.(504.05)
If an arrestee has been exposed to an Electronic Control Device outside of jail custody, whether by probes or “drive stun” what needs to happen?
Subject must be transported to a medical facility by the arresting agency for an “okay to book” before being booked into custody. (504.10)
•Can a Safety Cell be used for punishment or disciplinary housing?
No. Safety cells shall not be used for punishment or disciplinary housing under any circumstances. (504.24)
How often will an inmate be evaluated in the Emergency Restraint Chair by medical?
•Answer: Medical staff will evaluate the inmate upon initial placement in the ERC and every hour thereafter. The initial evaluation must occur within one hour of placement.
•Medical staff shall review the inmate’s health record for any health concerns regarding the inmate’s placement and retention in the ERC. Any identified concerns will be immediately communicated to a sergeant.
•The sergeant will determine if the inmate needs to remain in the ERC. A notation will be made on the Safety Cell/Specialty Housing Log by the sergeant if it is determined the inmate’s violent or self-destructive behavior warrants the inmate remaining in the ERC.
•The watch commander will determine if the inmate can be restrained in some other fashion that will provide for the inmate and staff’s safety while minimizing the inmate’s health concerns. (507.07)
If you suspect that a newly booked inmate may be a juvenile and was booked as an adult what should be done?
•Separate and keep by themselves. Have adequate supervision. An investigation will be conducted. The investigation will include a search of the California Identification system as well as accepting information from the individual's family. Acceptable means of identification include a Birth Certificate, California Driver’s License, Passport, etc. A supervisor shall evaluate the validity/authenticity of the documents.
•If an inmate is found to be a juvenile, he/she shall be released as follows:
•Prior to arraignment, the arresting agency shall be notified and the inmate will be released to the arresting agency. The release type will be booked in error (ERRO.)
•After arraignment, the inmate shall be released to other agency (RTOA) and the Sheriff’s Department will transport the inmate to Juvenile Hall. (504.12)
If a sobering cell is occupied, when will the floor supervisor review the sobering cell log?
At least once every four hours and document it on the Sobering cell log. (504.05)
The ultraviolet counterfeit detection scanner and a counterfeit marking pen should be used to scan bills over what denomination?
$20.00 and higher (504.10)
•How often shall an Inmate placed in the safety cell receive direct visual supervision? Where should it be documented?
Direct visual observation at least twice every 30 minutes, with no more than 15 minutes lapse between safety checks by custody staff. Safety checks shall occur at random and varied intervals. This will be documented on a “Safety Cell /Specialty Housing Log” (504.24)
How often will an inmate be evaluated in the Emergency Restraint Chair by mental health?
Mental Health staff will evaluate the inmate as soon as possible, but in no case longer than four hours from the time of placement in the ERC. (507.07)
Who is a Foreign National?
A foreign national is any person who is not a U.S. citizen. (504.33)
Can Assistive mobility devices such as a cane be allowed in the sobering cell?
Assistive mobility devices (e.g., crutches, canes, walkers, wheelchairs, etc.) will not be permitted in sobering cells, unless medical staff determine otherwise. If an inmate is to retain an assistive device, the inmate will be placed in a cell alone. (504.05)
What is done with excess personal property?
Excess property is not accepted, arresting agencies will be advised to keep the property for safekeeping or release it to a responsible party. (504.10)
When a Safety Cell is occupied, how often shall a supervisor review the safety cell log?
At least once every 4 hour to verify staff are documenting all visual checks in accordance with safety cell use guidelines and document on the Safety Cell log. (504.24)
How often will custody staff visually check an inmate in the ERC?
Custody staff shall visually check the inmate twice every 30 minutes for the inmate’s safety and well-being.(507.07)
When will a Consulate Notification be done for foreign nationals?
It will be done when it is a mandatory country. To determine if notification is mandatory, refer to the US Department of State, “Consular Notification and Access” handbook found at the Intake Desk. All foreign nationals are entitled to consular notification and access, regardless of their visa or immigration status. (504.33)
Can an inmate stay in a Sobering cell for over 6 hours?
In no case will an inmate remain in a Sobering cell more than six hours without a recorded evaluation by a medical staff member. (504.05)
Can an Arrestee keep their wig on them?
No, they will not be permitted to keep, they become personal property, they will be searched, and placed in their personal property. (504.10)
How often will a cup of water be offered to an inmate in the safety cell?
Inmates will be offered a cup of water periodically and upon inmate request. Offers of water will be documented on the Safety Cell/Specialty Housing Log to include refusals.( 504.24)
Can an inmate in the ERC use the toilet?
The inmate shall be given the opportunity to use the toilet periodically and upon request unless a sergeant determines it is unsafe. If the inmate becomes violent as the restraints are being removed, the staff member(s) shall not release the inmate and shall try again in thirty minutes. (507.07)
How do you handle an arrestee that is a citizen of two or more countries?
A person may be a national/citizen of two or more countries. In these cases, the foreign national should be treated in accordance with the rules applicable to each of those countries. This could mean that more than one notification will be required. (504.33)
Are artificial limbs or other prostheses permitted in the sobering cell?
Artificial limbs or other prostheses will be permitted after the item has been searched thoroughly and at the direction of a sergeant, who will consult with medical staff, if available. This approval will be notated on the Sobering Cell Log. (504.05)
