What is the 5th amendment?
Another name for an attorney
What is a lawyer?
Data presented to the court which may include the testimony of witnesses, records, documents, or objects
What is evidence?
A length to time that you would have to spend in jail
What is a sentence?
Procedural fairness and requires you to be given the notice of the charges against you, and the opportunity to contest those charges
What is Due Process?
The right of people to be secure in their persons, houses, papers, and effects against unreasonable search and seizure (often includes warrants)
What is the 4th amendment?
Attorney who works with you and helps your defense
What is Public Defender/Defense Attorney?
A person who actually saw the act and can give a firsthand account of it
What is an eyewitness?
Instead of going to jail, the judge orders you to do some things, and cannot do other things.
What is probation?
This rule prevents evidence gathered illegally from being used at trial
What is the exclusionary rule?
The right to a speedy trial
What is the 6th amendment?
Lawyer who investigates, charges, and prosecutors people who think they've committed a crime
What is a prosecutor?
Evidence that strongly suggest something, but doesn't exactly prove it
What is circumstantial evidence?
Payment for damage or loss of property.
What is restitution?
Advocating on one's own behalf before a court rather than being represented by a lawyer
What is Pro Se?
File a notice with a lower court, indicating intention to take matter to higher court
What is an Appeal?
Person in charge of court and makes final decision in legal disagreement
What is a judge?
A person whom a defendant relies on to establish an alibi
What is an alibi witness?
The judge gives you a length of time to show you can do well and not get in trouble. If you do well, you WILL NOT be prosecuted.
What is deferred sentencing?
Evidence in the form of testimony from a witness who actually saw, heard, or touched the subject without relying on other evidence
What is Direct Evidence?

What is the Miranda Warning?
A person who makes a word for word record of everything that is said in the court
What is a court reporter?
Secondhand testimony. Offered by a witness as truth, but statement actually made by someone else.
What is hearsay testimony?
The judge has found you guilty and imposed a sentence, but believes you can do well, and give you the opportunity to not serve your sentence.
What is suspended sentencing?
This is like a special "mental health probation" in which someone who has been found NGRI agrees to special terms or "conditions" so that they may return to the community with approval of the court.
Conditional Release
