This resident has successfully completed their competency evaluation or is close to doing so. They are knowledgeable about the legal system and display appropriate behavior. 

What is advanced/maintenance?

This area of competency requires the resident to know what offense they are accused of committing, what they were arrested for, and what their charge is. The resident also knows the legal terminology for their charge. They are able to understand the difference between being accused of committing an offense and being guilty of the offense. 

What is appreciation of charges?

This plea means that you are innocent and that you did not commit the crime. If you make this plea, then you will go to trial and the case will be decided based on the evidence and witnesses. 

What is a plea of not guilty?

The "boss" of the court. Decides what rules to follow; issues orders; instructs the jury about the rules of the law; sets dates for hearings and trials; decides guilt or innocence in a bench trial; and decides on a penalty or sentence if you are found guilty.

This type of plea means you admit that you committed the offense and is often entered as part of a negotiated agreement with the court based on the advice from your attorney.

This is an agreement where a defendant pleads guilty to a lesser offense in exchange for a reduced penalty, and in doing so, gives up certain rights, such as the right to a trial, to face accusers in court, and to appeal.

A lawyer that is against you and who is paid to prosecute you. Their job is to prove that you are guilty. They try to get a hard or heavy penalty if you are found guilty.

This resident has a poor ability to understand or communicate information because of disorganized thinking. This resident may need treatment intervention for psychosis-related symptoms in order to participate in group court education classes.

This area of a competency evaluation focuses on how a resident interacts with others and includes factors such as trust, cooperation, motivation, memory, clarity of communication, truthfulness, and reality orientation.

What is the capacity to work with attorney/disclose information?

This plea means that you are not disputing the charge. You accept whatever the court gives you, and you will not have a trial. By doing this, you give up your right to appeal the sentence and your right to remail silent in exchange for a lighter outcome and a faster conclusion to your case. Also known as "nolo contender."

This plea means that you are asking the court to hold you not responsible for your crime because you were mentally ill at the time. You are required to have a mental health evaluation. You might need be required to be sent to a hospital for long-term treatment.
