NYS has "mandatory arrest" for domestic violence cases. This means that in an intimate partner relationship, the police MUST make an arrest when:

- a felony is committed, a person disobeys an order of protection. 

Police do not have to make an arrest if there is no order of protection or the abuser commits a misdemeanor crime. 

The police are not allowed to ask if the victim wants the abuser arrested or if the victim wants to "press charges". But the police can make an arrest if they think that is the best course of action.

Submit the written paper copy of the LDSS-2221A form originally signed to: the Local County Department of Social Services (LDSS) where the abused/maltreated child resides.

A call to the SCR must be made within 24 hours of the disclosure.

A victim of domestic violence must experience physical injury in order to request compensation through OVS

Myth

As long as there is a police report/ DIR with charges listed on it or a family offense petition with an order of protection, a victim can submit an OVS application using loss of essential personal property without an injury. Victim would need to make a list of items left behind after fleeing the home and detail the approximate cost of each individual item.

Requesting cost for therapy is also allowable when no physical injury has occurred
