Tory shares a joint bank account with her twin sister Rory. Tory is on SSI while Rory is not. The bank account has $1000 in it. How much is a countable resource for Tory?
Because Rory is not on SSI, the full amount is presumed to belong to the claimant. $1000 is countable to Tory.
Peter Parker is drawing SSI benefits. During a review he alleges he received an $1800 payout from the casino. Are these gambling earnings earned or unearned income?
Unearned
Claimant is applying for concurrent disability (both T2 and T16). They allege they are still working and countable earnings end up being $1600 a month. Will you deny the SSI claim as N01 or N33?
N33. They are over SGA but not past the breakeven point. If they were over the breakeven point, it would be N01.
Tony is applying for SSI only. Their AOD is 1/1/2022 and there is no work after that date. Their protective filing date is 7/1/2023. What should you list as their POD?
We took a full claim for Chelsea on 2/3/2023. We sent the case to DDS, and she received an allowance on 8/15/2023. Does this case require a PERC?
Yes. Although it is a full claim, the DDS decision took more than 120 days.
What development is needed when a claimant has a life insurance policy?
A copy of the policy that should show the owner, insured, face value, CSV, and if the policy pays dividends
Margaret's mom gives her $50 in cash to help out once every six months or so. This income is excluded under what concept?
Irregular or Infrequent Income
Michelle gives an AOD of 6/1/2022. She alleges arthritis as her disabling condition. She worked from November 2022 to January 2023 and worked over SGA. She stopped working there because she thought the job was boring. Does a UWA possibly apply?
No, the work must have lowered or ceased due to impairment related reasons.
POD = AOD, 9/15/2022.
Horatio is a permanent resident (LAPR) applying for SSI. He has been a LAPR and in the United States since 3/2/2012. He has been here continuously. He has never been a veteran, a refugee, or been married. He has 40 work credits. Is he a qualified alien?
Yes
Katherine is on SSI. She cannot afford the mortgage anymore, so she sells the home for the current FMV of $215,000 and rents an apartment instead. Is this a transfer of resources that is subject to the period of ineligibility?
This is a valid transfer and it is not subject to a period of ineligibility because she did receive the full FMV for the property.
Rita lives with her adult son Rico. Rita gets court-ordered child support arrearages on behalf of Rico from Rico's father, totaling about $400 a month. She keeps the money herself. Is this income to Rita or Rico?
Rita. Child arrearages paid to the parent of the adult child, who also keeps the funds, is income to the parent.
Frida is applying for T2 disability. She provides an AOD of 1/1/2022, but she worked all of 2022. For the first 7 months she made $1500 a month, and the last 5 months she cut her hours and switched job responsibilities, and only earned $1200 a month. Does averaging apply?
No, there was a signficant change in work patterns so averaging will not apply.
Timothy is applying for T2 disability. His protective filing date is 7/18/23. His AOD is 8/31/2022. His insured period is 1/1/2012-12/31/2024. His last day of SGA work was on 10/31/2022. You do an SSA-821 and there are no subsidies/irwes, and averaging/UWA does not apply. What should we recommend as a POD?
10/31/22, or the last day he worked SGA
Which one of these claimants would require a wet-signed SSA-827 no matter what: Timothy (age 4), applying for SSI; Chrissy (age 14) applying for SSI, or Harold (age 56) applying for SSI/SSDI.
Chrissy. For children between the ages of 12-18, we must obtain a wet-signed SSA-827. The 827 requires two signatures, one from the child and one from the parent/guardian.
Martin is a DC applying for SSI. His father owns a vehicle worth $3500, a bank account with $600 in it, and a 401k through his job worth $9000. His mother owns a vehicle worth $5000 ($2000 loan on it) and has $20 in her bank account. Martin has no resources fo his own. Is Martin eligible and what are the countable resources?
The 401k is not deemed, and the father's vehicle is the value with the highest EV. So 3000 for mom's car + $620 for the bank accounts = 3620. 620 is deemed to Martin, he is eligible.
Harley is applying for SSI benefits on 8/17/23. His ineligible spouse, Quinn, earns $1900 in wages a month, while his only income is $350 from a private pension. They have one IC with no income. They live in a house they own. Is Harley eligible for SSI?
Yes
Claimant provides an AOD of 1/1/2023. Today is 5/27/23 and the claimant has been working all year and is still working. Their earnings are $500 a month. How will you document the work in EDCS?
You will document in EDCS on the onset tab that "earnings are under TWP, clearly not SGA."
Leonardo is applying for T2 disability. His AOD is 12/31/2020. His insured period is 6/30/2021-6/30/2024. He continued to work over SGA until 3/1/2021. What should we recommend as a POD?
6/30/2021, or his DFI. Even though he stopped working SGA on 3/1/2021 he was not insured at that time.
Jim is applying for SSI aged. His protective filing date is 5/8/2023, but he turns 65 on 5/25/2023. What is his effective filing date?
The effective filing date will be 5/24/2023. It will be the day she attains age 65 (but for social security, we put that as the day before their actual birthday).
You run eAFI on Giselle's bank accounts. The balances are as follows: The August 2023 balance was $2882. You query her record and see she got an SSI backpay installment in that same account in October 2022 of $2682. What is her countable amount in her bank account in August?
$2423. The backpay was paid October 2022, so the 9 month exclusion runs from November 2022 until July 2023. The amount in the account for August is fully countable.
Provide 3 examples of primary evidence of wages (maybe this a test on how fast you can navigate policynet?)
1. pay stubs 2. SSA approved wage verification company (I'll accept The Work Number) 3. Oral statement from employer 4. Written statement from employer
Priscilla has work over SGA after her AOD. The work was consistently above SGA and she worked there for nine months. She alleges several accommodations that may indicate a subsidy. What form could you send to the employer to see if a subsidy applies?
SSA-3033
When you ask Veronica (age 50) about her AOD for T2 disability benefits, she says she's had this condition "since she was a teenager." After reviewing her earnings record you see she was working consistently over SGA from 2010 to 2020. Give me an example on how you would use your interviewing skills to help her adjust her AOD to something more appropriate.
"I understand these conditions have been affecting you a very long time. For SSA, we look specifically at when your conditions affect your ability to work. I see that your work stopped or substantially decreased around late 2020 / early 2021. Was that because of a worsening of your conditions?"
What are two ways to build the SSR (two methods)? (I want specifics!)
