The law requires reporting abuse of children under 18 years of age.
Counselors need to consider the risks and benefits of accepting clients who they have had a pervious relationship with. Ex: a causal, distant or past relationship with someone they've worked with or friends etc.)

Is this a legal or ethical issue?
In most states, it is illegal.
California, Colorado, Connecticut, Delaware, Florida, Georgia, Maryland, Michigan, Minnesota, Mississippi, New Hampshire, New Mexico, New Jersey, Washington etc. All states require counselors to avoid such behavior due to the (ACA) ethics code, which prohibits sexual relationships with current and former clients.
Counselors are prohibited from engaging in counseling relationships with friends or family members.

In New Jersey, the minor can consent for themselves. Needs to be at least 16 years of age to consent.
