In most states, it is illegal. 

California, Colorado, Connecticut, Delaware, Florida, Georgia, Maryland, Michigan, Minnesota, Mississippi, New Hampshire, New Mexico, New Jersey, Washington etc. All states require counselors to avoid such behavior due to the (ACA) ethics code, which prohibits sexual relationships with current and former clients.
