There are 3 PDP steps that FLSA applies to, name one of them.

The FLSA applies to participants working in unpaid JOBS work activities (CP~ Community Service Program, SW~ Supported Work and WE~ Work Experience). FLSA requires that participants engaged in these activities not work more hours than the combined value of the TANF and SNAP benefits divided by Oregon minimum wage in the county in which the participant resides. JOBS- Volunteer is a participant in the TANF need group who is federally mandatory and eligible to engage in JOBS but may not be disqualified as they meet at least one of the following state exemptions (name 3 of 7):

  • Participants who are pregnant and have reached the first of the calendar month prior to the month in which the due date falls.
  • Participants experiencing documented medical complications due to pregnancy that prevent engagement in activities of the program.
  • Single parents, 20 years old or older or has a high school diploma, or GED and is 18 or 19 years old, with a dependent child under six months.
  • Single parents, under 20 years old without a high school diploma or GED, and with a dependent child under 16 weeks.
  • For two-parent families, one parent to care for a child under 6 months old.
  • A VISTA volunteer.
  • Participants with an undue hardship. Must be staffed with a TANF policy analyst.

  • After. This letter is only to be used after eligibility has been completed on a Support Service or TADVS payment and the payment has been authorized in ONE.

JOBS-exempt individuals are adults who are in the needs group that meets a federal exemption and not eligible to engage in the JOBS program. They cannot volunteer for the JOBS program.

Parents providing care for a family member living in the home who has a disability. **If parent is requesting to engage in JOBS and receive support services, the JOBS exemption would be ended.

Non-citizen participants who are not authorized to work in the US. 

Individuals who are eligible for and receiving SSI from Social Security Administration. 

Non-needy caretaker relatives. 

For REF participants aged 65 years of age or older, or those for whom participate is likely to cause undue hardship to the individual.

There are some payments that are not allowed with JOBS Support Services, name 4 of them:

• Any payments related to employment in, seeking employment in, or engaged in a federally prohibited activity (see OAR 461-120-0215);

• Child care payments including ERDC co-payments and registration fees;

• Legal costs, including fines, reinstatement fees, court costs, restitution, expungement or other costs associated with a penalty;

• Medical treatments or services including mental health or alcohol and drug treatment. Medical services are not allowable under the Social Security Act 408(a)(6); 

• Non-essential items, such as television and cable;

• Entertainment, such as amusement parks, movie tickets, sporting events, county and state fairs;

• Debt held with a collection agency;

• Animal related costs including pet deposits, pet fees, kennels, etc.;

• Purchase of a motor vehicle such as a motorcycle, car, recreational vehicle, or motor home.

• Purchase of a firearm or other items intended to be used as self-defense or as a weapon.

  • A person who has fled from a felony conviction or has violated the conditions of their parole or probation

How long does a JOBS Plus typically get set up for (how many months)?

  • Up to 6 months. Instead of receiving TANF and SNAP, participant receives a paycheck from the employer and the employer is reimbursed for wages and payroll taxes.
  • Employer pays $1 into an Individual Education Account for each hour the employee works, beginning 30 days after the person starts the job
  • Employer allows 8 hours of paid job search as part of the regular work week if the person has not found unsubsidized employment after 4 months

Federal funding cannot be used to support activities that are deemed illegal under federal law. When an individual gains employment or is seeking employment in a prohibited activity they are not eligible for (there are 4 items) please name 2 items:

• Jobs Participation Incentive (JPI)

• Reduced Co-pay (RCP)

• Employment Payments (EPCA)

• Support Services

**Also, JOBS participants not allowed to have an active TRACS step to record engagement in these activities as these hours are not countable, when individual gains employment in a prohibited activity, placement is not allowed to be captured in TRACS.
