Who bears the risk of damage, and why?

Under DAP, the seller bears the risk until the goods are delivered and placed at the disposal of the buyer at the named place, ready for unloading. Since the damage occurred during unloading, the risk had already transferred to the buyer, and therefore the buyer bears the loss.
