What was the Commonwealth v Fisher case?
Commonwealth v Fisher is an important case because it shows us how the state could handle Juvenile offenders. Fisher was 14 when he was sentenced to a reform school and Fisher appealed that he shouldn’t be sent away without a proper trial and his rights were being violated. The Pennsylvania Supreme Court stated that the law's purpose wasn’t to punish children but to protect them. The state intended to act like a parent trying to prevent the child from breaking any law further.
What was Haley v Ohio case?
The Haley v Ohio case happened in 1948 when William Karam was shot and killed in his store by either Alfred Parks age 16 or Willie Lowder age 17. John Haley, age 15 was waiting for them outside the store when the shooting occurred. Five days later, he was arrested at his home after midnight on a Saturday and taken to the police station. After arriving, the police questioned Haley for about 5 hours, Haley confessed at about 5 am Saturday. The police never read Haley his right. Haley and his mother say the police have beaten Havely. His mother testified that the clothes Haley wore when arrested were torn and blood-stained, she also testified that Haley was bruised and skinned when she first saw him after his arrest. The police refused to ever beat Haley. His mother or the lawyer was refused by the police to meet with Haley. His mother couldn’t meet him until Thursday. Haley never met with a judge nor was he formally charged until three days later when he signed the confession. Haley was convicted of first-degree murder and sentenced to life in prison.
