Charles Schenck passed out pamphlets showing the propaganda against the draft for WWI. He argued that he had his freedom of speech when he was accused. The Supreme Court ruled that the government could restrict speech during a time of war if it was "clear and present danger."

Fred Korematsu, a US citizen, refused to follow the exclusion order and was arrested. He argued his rights for the 5th Amendment and that this stemmed from racism. The Supreme Court ruled that the internment was necessary because it was instituted by the military.
