A student pleads for you not to report his/her behaviour, what is your obligation regarding Safes School legislation?

You must report incidents even if a student asks you not to tell anyone about an incident. You must report the incident to the principal as soon as it is safe to do so.

If you report incidents to the employer are you supposed to sustain reprisals.

•In Ontario, the Occupational Health and Safety Act (OHSA) sets out roles, rights and responsibilities for employers, supervisors and workers.

•Under section 50 of the OHSA, workers are protected from reprisals. This means, your employer is not allowed to:

•fire or threaten to fire you

•suspend or discipline you, or threaten to do so

•intimidate or coerce you including, for example, bullying you or strongly encouraging you not to report

•impose any penalty upon you including, for example, transferring you to another position, shift or work location, reducing or changing your hours or denying you a raise or benefits that you’re entitled to

Types of incidents you must report pertaining to Safes School Reporting?

  • utters a threat to inflict serious bodily harm on another person
  • possesses alcohol, cannabis (unless the student is authorized to use cannabis for medical purposes) or illegal drugs
  • is under the influence of alcohol or cannabis (unless the student is authorized to use cannabis for medical purposes)
  • swears at a teacher or at any person in a position of authority
  • commits an act of vandalism that causes extensive damage to school property at the student's school or to property on school premises
  • bullies another student, including cyber-bullying
  • does any other activity that is identified in school board policy

When should you  notify the on-site supervisor regarding work refusal

A worker can only refuse work when he or she has reason to believe that the work is dangerous and unsafe.

Both, although personnel may not have been injured the violent act is of concern and also would require ERWVI and Safes School reporting.

All school board employees are required to report incidents in writing to their principal.
