SECTION 7 BASICS
Under the ESA Section 7 regulations, this area includes all areas to be affected directly or indirectly by the proposed action.
What is the action area?

Reinitiation of consultation
When NMFS designates critical habitat for a fish species above an unpassable barrier, it is designating this kind of critical habitat which must be essential to the species’ conservation.
What is unoccupied?
The section of the biological opinion that refers to the condition of the listed species or its designated critical habitat in the action area, without the consequences to the listed species or designated critical habitat caused by the proposed action.
What is the environmental baseline?
This type of consultation is required when the proposed action is likely to jeopardize the continued existence of a proposed species or destroy or adversely modify proposed critical habitat.
What is a conference opinion?
Under the ESA section 7 regulations, if an effect is caused by the action, but is later in time and reasonably certain to occur, it is this kind of effect.

What are 'but for’ and ‘reasonably certain to occur’?
This section of the ESA prevents an action agency from making any irreversible or irretrievable commitments of resources that would preclude the development of an RPA after initiation of consultation.
What is section 7(d)?
This section of the ESA directs Federal agencies, in consultation with and with the assistance of the Secretary of the Interior or Commerce, as appropriate, to utilize their authorities to further the purposes of the Act by carrying out conservation programs for listed species.
