A person collects only if his/her negligence is less than the other party’s. Thus, one does not collect at 50% or equal fault. For example, if the plaintiff is 30% at fault, he/she collects 70% of his/her damages. At 50% neither party collects from the other nor is required to pay anything to the other party.
