An adult to whom a self-directing consumer has delegated authority to instruct, supervise and direct the consumer directed personal assistant and to perform the consumer's responsibilities specified in subdivision (g) of this section and who is willing and able to perform these responsibilities. With respect to a non self-directing consumer, a "designated representative" means the consumer's parent, legal guardian or, subject to the social services district's approval, a responsible adult surrogate who is willing and able to perform such responsibilities on the consumer's behalf. The designated representative may not be the consumer directed personal assistant or a fiscal intermediary employee, representative or affiliated person.

What is CDPAP?
CDPAP stands for the Consumer Directed Personal
Assistance Program. This is a Medicaid program in
New York State that lets people who need home
care choose, hire, and manage their own
caregivers. More information on the program can

During this transition, will I be considered a new hire and require the two step PPD, and if so, will PPL pay for that?
The PPD is required of personal assistants. PPL will pay costs for this test. We will provide you with more information regarding when you will need to complete this when you transition to PPL.

What services does PPL provide to support consumer-directed care?
PPL helps with payroll, taxes, claims, health and safety, fraud checks, program accounting, and analytics, making it easier for people to manage their care needs.
May family members serve as the personal assistant?
Yes, you can hire family members, but there are some rules. Spouses cannot be paid personal assistants, and parents cannot be paid caregivers for their children under 21 years old. For the app used for signing in and out, does that need to be the consumer's phone?
Our EVV app is called Time4Care and is what both the PA and Consumer will use. So, no, it does not need to be on the consumer’s phone. Each person will have a unique username through the app, so any smart phone that allows for accessing an app can be utilized. For individuals who want to use a web-based application, PPL@Home (or the Portal) will provide a unique username for each person. So, the consumer, representative and PA will each have their own username. If the representative will be signing off on timesheets, they can login from their computer (or smart phone) to approve the time. Individual designated to represent and act on the individual participant’s behalf. The Authorized Representative may be an attorney representing a person or household, a person acting under the authority of a valid power of attorney, a conservator over financial matters, a legal guardian, or any other individual designated in writing by the eligible participant. The Authorized Representative can also act as the Employer of Record (EOR) if he/she is not a paid self-directed services provider for the member/participant.

A power of attorney (POA) is a legal document that allows someone to act on your behalf, such as making decisions about your finances, health, or estate. The person who gives the power of attorney is called the principal, grantor, or donor, and the person who receives it is called the agent.
What training and support does PPL give to consumers and caregivers?
PPL offers training sessions online or in person, and we can even come to your home. We also provide training on how to use electronic visit verification, or EVV, systems as well as ongoing support to reduce mistakes and help people feel confident in managing their care.
What are the benefits of CDPAP?
CDPAP gives you control over your home care. You can pick someone you trust to be your caregiver, such as a friend or family member, and pay them for their time.

Are you still going to pay overtime?
Overtime is sometimes necessary to ensure services are provided timely. We will provide the details of our overtime policy to consumers and personal assistants during the transition process.
What are the requirements to become a caregiver under CDPAP?
To become a CDPAP caregiver, you’ll need to
provide certain documents, including:
A valid photo ID (such as a driver’s license or
passport)
Social security card
Recent physical exam
Lab reports for rubella and measles
A recent TB test (or chest X-ray if the TB test is
positive)
These documents help us ensure that caregivers
meet basic health and safety requirements.
What forms (i.e. Difficulty of Care form) will be available with PPL?
The Difficulty of Care Form, along with other forms such as Consumer and Personal Assistant Agreement, Direct Deposit Form, Tax Exemption forms and more will be available with PPL.
