You meet someone on social media who tells you the place they work is hiring and you ask what the company name is.

No.  (Outreach Kit, Hiring Vet Medallion Info and one other piece of information needs to be provided to the employer rep when two way communication has happened)

100

You connect with an employer on Facebook who posted that they are hiring for CDL Drivers.  You ask them if you can help them advertise the job and they agree.

Job order, because you are advertising it on WIT and have thier permission.

100

You host the employer at the AJC to accept applications and resumes.

Interview Room

A veteran contacts you because they heard you help veterans get good jobs. You offer to help them write a resume and do job search.

No.  Veterans must be triaged by the AJC staff and if you find opportunities that fit the veterans skills, you can connect them with the employer's jobs as a service to the employer.

100

You are reviewing new job orders for possible referrals and you see the following:

"Candidates must be under the age of 30 and physically fit and reasonably attractive"

Bring the job order to the attention of the local Business Services Unit Supervisor. Do not try to correct the employer yourself.

An employer emails you about an opening they have coming up and want you to refer more veterans like the ones you have in the past, and you agree.

Yes, but notes must indicate that you have provided the ORK/HVMP info previously.

200

You meet a veteran who has experience as an electrician and you email the resume (without contact info) to several employers to see if they would be interested in the veteran. An employer responds thanking you for the resume and asking for the contact info.

JD.  There is no reason to post it in WIT as a job order since you have already made a connection between the veteran and employer.

*You must first confirm the employer doesn't have an active job order for that occupation in WIT.

200

You invite two employers to an Industry Focused event for Hospitality and they attend.

Job Fair (multiple employers)

An employer opens a new small business in your town and needs to hire but doesn't have a TWC tax number yet. They ask you to help them hire with a job order on WorkInTexas.com

Yes, the account can be staff approved and you can provide them with info, forms and links to apply for a TWC number. They may not need to obtain one immediately.

Who is subject to Texas unemployment tax?

An employing unit that is liable under the Federal Unemployment Tax Act ( FUTA ) and has Texas employees. An employing unit that pays $1,500 or more in total gross wages in a calendar quarter, or has at least one employee during twenty different weeks in a calendar year regardless of the wages.

Once wages are paid, employers should register with the Texas Workforce Commission ( TWC ) within 10 days of becoming liable for Texas unemployment tax.

A veteran contacts you and says the employer you referred him to, promised them full time but has cut thier hours several times and they are only working about 24 hours per week and not making enough to support themselves.

Contact the employer to ask for feedback about the veteran or if they are experiencing a business turn-down.

Business turndown: They may need help from the AJC Board/Business Services to prevent complete shut down or layoffs.

Veteran not performing well:  Maybe they can get a training grant (TWC SkillsGrant) to provide training to the veteran. Perhaps the veteran has other issues that can be addresses with various resources.

The veteran may be eligible for partial unemployment or may need to reactivate their job search if the problem cannot be resolved. Refer them to your AJC partners for assistance.

300

You send an outreach kit to an employer who posted a new job order in WIT.

No, two-way communication hasn't taken place yet.

300

You tell a veteran to apply for a job you saw on Indeed that matches their interest.

Neither, you must connect with the employer and they must agree to accept the application, resume or to interview the veteran for a JD or give you permission to post the job on WIT.

300

You facilitate an employer event at a hotel where they reserved space.

Employer Site Recruiting

A business owner connects with you on Facebook and tells you they want to hire framers for a construction job they just started.  The employer gives you the info to post the job on WIT. They will be 1099 employees.

No.  The business will not be the "employer" and is therefore not permitted to post on WIT for these positions. 1099 means the individuals will be self-employed and responsible for their own taxes.  The employer agreement on WIT clearly states the job must be as a valid employer of record.

300

You connect with a new employer to advocate for veteran hiring and they tell you they don't want to hire veterans because they may have PTSD issues and put their staff and/or customers in danger.

Provide the employer with training about PTSD, who veterans are and they value they can bring to their company.

400

You connect with an employer at a Business Expo and exchange cards and discuss services we offer and their needs.

No, you haven't provided them with the Outreach Kit yet.

400

Your VCA Case Conferences with you and a veteran with skills in Marketing.  You reach out to a local business and ask if they are interested in the veteran's resume.

Job Development, as long as it isn't a position already advertised for the employer in WIT.   Make sure you document it in VCMS and on the job seekers WIT account... because if it isn't documented, it DIDNT happen!

400

The employer asks if you would help them learn how to navigate WIT

Employer Service - Other Orientation - WIT

TWC hosted Event - Employer Training

400

An employer contacts you to help them recruit for positions outside the country.  They are a Federal Contractor.  Can you post jobs for employment in other countries?

Yes, as a Federal Contractor, recruiting active and prior military for overseas service, you would enter the job using your local zip code, but the job description must state the job requires travel to other countries.

400

You are searching for job orders to see what new in your area.  You see a job that says  "DO NOT REFER WITHOUT HARD COPY CLEARANCE ORDER
Temporary work from: 09/01/2023 - 06/30/2024"

Can you search for and refer candidates or outreach this employer?

Absolutely not.  You have not received proper training for these, and there is an entire book of legalities with them.  They are entered into WIT by the Foreign Labor Certification Unit at TWC.
