A crime victim has the following rights:

To be treated with fairness, respect, dignity and privacy

To be reasonably protected from the accused throughout the criminal justice process

At the request of the victim:

Notification of court proceedings.

To be present at all public court proceedings related to the offense, unless court determines that the victims testimony would affect the trial.

To confer with a rep. from the prosecutors office.

To restitution.

To receive information about the conviction, sentence, imprisonment, and release of the accused.

What is a Forensic Medical Examination and how is it requested?

CCP Art. 56A.303.  FORENSIC MEDICAL EXAMINATION 

(a)If a sexual assault is reported to a law enforcement agency, within 120 hours after the assault, the law enforcement agency, with the consent of the victim of the reported assault, a person authorized to act on behalf of the victim, or an employee of the Department of Family and Protective Services, shall request a forensic medical examination of the victim for use in the investigation or prosecution of the offense.

Is defined as a person

who is the legal guardian of the victim, whether or not the legal relationship between the guardian and victim exists because of the age of the victim or the physical or mental incompetency of the victim.

—Texas resident, US resident who is victimized while in TX, a Texas resident victimized in another state or country that does not have a crime victims compensation fund.

—Crime must be reported to law enforcement within reasonable period of time, but not so late that it interferes with or hampers the investigation and prosecution.

—Victims must to cooperate with law enforcement.

Victims of violent crimes who suffer physical or mental harm as a direct result of the crime.
