What is a fixed term lease?
A lease that is entered into for a period of time from the day of commencement and day of termination stated in the lease.
What is the reason behind having a security deposit?
It is a cost-effective way to ensure financial safety to both the landlord and tenant
When should a landlord present the rules to the tenant?
Before the signing of the lease.
Are you required to have tenants insurance?
No, but if a landlord requests it then it will be required.
Is there an application fee?
No, if a landlord is trying to charge you an application fee, they are in the wrong
Are you able to break a lease due to mental health?
Yes you are legally able to break a lease due to mental health as long as you able to meet the criteria.
How much is the security deposit suppose to be?
It can only be half of one months rent
When can a landlord enter the property?
Unless its an emergency, 24 hours notice is required and must be at a respectable time/during day light.
Are the tenants responsible for finding a sub-letter?
Yes, they are responsible for sub-letters and/or paying the rent until they do so. The sub-letters must be approved by the landlord.
What does the "anniversary date" refer too?
The day which the lease begins.
Is domestic violence a legal reason to terminate a lease?
Yes it is, as long as you meet the criteria.
1. Complaint has been filed with police
2. A peace bond or other order of court has been issued
3. After completing an assessment, the director of victim services has reason to believe the tenant is a victim of abuse
How can a tenant ensure they get the full amount back?
Treat the premises with care to avoid any unnecessary damage to floors, walls, fixtures etc.
How long does a landlord have to hold onto the tenants personal belongings?
At least 60 days until they are able to throw away or use towards remaining rent owed.
As a tenant are you responsible for the cost of repair or a new appliance?
No, it is the landlords responsibility to handle those situations.
When can a tenant be terminated from the property?
If there is constant bad behaviour, damage or lack of cleanliness to the unit or rental arrears of 15 days or more.
Are service animals still allowed even if the lease states "no animals"?
Yes, you can't deny service animals
How many days does the landlord have to return the deposit?
The deposit must be returned within 10 days with either the full amount or deducted amount with proof of reason
Are landlords required to know the names of every person living in the premises?
As a landlord you must approve every occupant living on your property.
If a landlord only gives you one set of keys, and there is 3 of you living there, what should you do?
The landlord needs to make as many sets needed as there are people living there.
When can a landlord increase rent?
Must have at least 4 months notice prior to the end of a fixed term lease, unless you live in manufactured home then its 7 months.
What are a few things that a lease must include?
The start date
Contact information for the landlord, Description of the rental space, Total rent cost per month
Appliances/services/utilities included in the rent
The amount of any security deposit
Requirements for ending the lease
What happens if a landlord violates the rights of the security deposit?
Any landlord who violates section 12 is guilty of an offence punishable on summary conviction and upon conviction is liable to a fine of no more then $5000.
As a landlord are you able to change the rules stated in the lease?
No, landlords are not allowed to change the rules unless its four months prior to the anniversary date.
What are a few of your responsibilities as a tenant?
Make sure to pay rent on time unless landlord has approved a late payment
Keep the property clean
Respect the rules of the landlord
Does the landlord have any control over selling the tenants part of a manufactured home (trailer)?
No the landlord should not restrict the tenant in any way to sell, lease or otherwise part with their possession of the manufactured home.
