What is 12?
A new charge if you lie in court.
What is Perjury?
The person in charge of the courtroom who makes sure everyone follows the laws and rules, gives instructions to the jury, and makes sure the trial is fair.
Who is the Judge?
The person saying that he or she committed the crime.
What is a Guilty Plea?
Physical objects OR testimony presented in court to prove or disprove facts.
What is Evidence?
When the judge is the one who hears the evidence and gives the verdict
What is a bench trial?
Crime punishable by more than 1 year.
What is s Felony?
This person is on your side, presents evidence in your favor and protects your rights.
Who is the Defense Attorney?
The person says that he or she did not commit the crime.
What is a Not Guilty plea?
Spoken evidence given under oath (or through an affidavit).
What is Testimony?
This amendment guarantees all defendants in criminal cases the right to a trial by jury
What is the 6th Amendment.
What is the Sentence?
The person accused of a crime.
Who is the defendant?
When the prosecutor and the defendant make a deal, and the defendant agrees to plead guilty in return for something (like a lighter sentence)
What is a Plea Bargain?
This amendment grants the defendant the right to protect himsef/herself from self incrimination.
What is the Fifth Amendment?
If the jurors do not agree on a verdict.
What is a Hung Jury
A new charge if you behave inappropriately or disrupt the trial.
What is Contempt of Court?
The person who helps the judge keep order in the courtroom.
Who is the Bailiff?
You don't admit or deny the charge against you.
What is a No Contest plea?
Questioning of a witness by the party who called that witness.
What is Direct Examination?
The discussion the jury has after the trial to determine the verdict.
What is Deliberations?
Being able to understand the proceedings against you and being able to communicate with and assist your attorney; knowing you charges and the court process.
What is Competency?
The person who represents the State of California, presents evidence against you and tries to prove you are guilty.
Who is the Prosecutor?
You admit the crime but say that you were mentally ill at the time and could not understand right from wrong.
What is Not Guilty by Reason of Insanity?
Questioning of a witness by the party that did not call that witness, eg questioning by the prosecutor of a witness called by the defense.
