How will I know I have completed the 911 program?

A person on 911 will have regular contact with a 911 monitor. The 911 monitor is the person’s link to the courts. As the time nears an end, make sure there is communication with the 911 monitor as to what you intend on doing upon completion. A conditional release is not completed officially until the judge dismisses your case. Don't assume your time is up and leave your placement. Your time frame might not be correct and you risk being revoked

Will I have to stay in a group home for the entire five years?

Depending on the discharge placement, a patient on Act 911 should expect to reside in the group home for the entire five-year probation. There are some exceptions to this rule. Some discharge placements are not considered long term and the patient will be permitted to leave and possibly return home if the treatment team, 911 monitor, and the judge approve. Some discharge placements allow the patient to immediately live in their own independent living situation in the community under supervision. This type of arrangement is not necessarily home but is not considered a group home or residential type living arrangement.

When does my 911 probation time start?

The patient should not expect their probation time to start on their 911 until they are officially approved for discharge from the hospital. On occasion, patients are discharged from the hospital by the courts but remain at the hospital for several days awaiting transportation to a specific facility. Their 911 probation time starts the day they were officially discharged by the courts, not the day they left the hospital.

What is a conditional release plan?


911 patients that are discharged will be conditionally released from the hospital by the courts. This means they will be permitted to leave but must abide to certain conditions. In other words, a conditional release plan is a list of things they must do or not do while they are on probation. A conditional release plan's purpose is not to punish, but to assist those leaving the hospital to stay out of the hospital. Conditional release plans will vary based on individuals specific treatment issues. If a person does not follow their conditional release plan, they risk being revoked. If a judge revokes someone it simply means they violated their probation and in most cases is ordered to return to the Arkansas State Hospital. If a person is revoked, their 5 year probation starts over and will not begin again until they are discharged from the hospital by the court.

Can one have their acquittal thrown out to avoid becoming a 911?

No. The time to win your freedom would have been at the Circuit Court hearing when they first acquitted you by reason of mental disease or defect. There is currently no appeals process for 911, unless you can prove that the acquittal was without cause, that is, that you did not ever really suffer from a mental illness or defect at the time you committed your legal charge. Even then, it would be up to the Circuit Court/Probate Division judge to believe this argument and release you at the first hearing, instead of placing you under Act 911, something the judge RARELY does.
