This rule protects materials prepared by attorneys in anticipation of litigation, including notes, research, and witness statements, shielding them from discovery by opposing counsel.
What is the "work product rule"?
These two discovery tools are often included together in the same request for discovery because they serve complementary purposes.
What are "Request for Interrogatories and Requests for Production of Documents and Things" or "CR 33 and CR 34"?
In most situations, a party must provide this many court days' notice of deposition to another party.
What is five days?
In 2013, CR 34 of the Washington Civil Rules was amended to include this specific category of documents aligned with electronic discovery.
What is "electronically stored information" or "ESI"?

What are "deemed admissions"?
In document-intensive cases, this rule in CR 33(c) allows a responding party to produce these in lieu of direct answers.
What are "business records" or the "business records option"?
This rule requires the preservation of electronic data and other evidence relevant to an actual, pending, or potential court action to prevent spoliation.
What is a "litigation hold" or "legal hold"?
This is issued by the judge when the discovery sought is privileged, protected by the work product rule, or irrelevant, thereby restricting a party's access or use of information.
What is a "protective order"?
Before I can be ordered by the court, good cause must be clearly demonstrated, or the parties must stipulate to my use.
What is a "Physical and Mental Examination of Persons" or "CR 35 Independent Medical Examination"?
No party may video record a deposition within this many days of the later of the date of filing or service of the lawsuit, absent agreement of the parties or court order.
What is 120 days?
CR 34 permits parties to request this for the purpose of conducting inspections relevant to the litigation, provided such requests are reasonably detailed and considerate of the property owner's circumstances.
What is "entry onto land"?
A formal meeting between the judge and parties' attorneys to plan for and set limitations on discovery.
What is a "discovery conference" or a "26(f) conference"?
In accordance with the King County Local Rules, when a party has propounded pattern interrogatories under LCR 33, they are allowed to serve no more than this many specifically tailored interrogatories.
What is fifteen?
I'm a set of written questions served upon a nonparty to be answered orally and on record, with responses captured by a court officer.
What is a "deposition upon written questions" or "written depositions"?
On DAY 1, the plaintiff serves the summon and complaint and a request for interrogatories on the defendant at the same time. The defendant has until this day to respond to the interrogatories.
What is DAY 41?
This type of motion involves a court order requiring the opposing party to disclose certain information or documents or to allow specific discovery activities.
What is a "motion to compel discovery" or a "motion for an order compelling discovery"?
