Grey area! Generally it’s best to avoid the appearance of impropriety. HOWEVER, you can offer limited assistance in completing the DS-160 online: answer questions honestly; not during work hours; receive no renumeration; recuse yourself from the case.

Can the DEA Attaché have the consular section door code so he doesn’t bother people when he comes to talk to the OCI about cases?

No. Access should be limited to the following employees: Consular staff, the Ambassador or PO and DCM, MSG, the RSO, the Facilities Manager, and the GSO.

Generally, no. The passport with visa should be returned to him as any other applicant’s passport and visa would at your post (GSS courier, etc). Any variations in this policy should be addressed in a post-specific SOP.

You receive a referral from the DCM for her children’s nanny to accompany them when she transfers to Washington, DC. Can you accept it?

No. Referrals may not be submitted for domestic staff, i.e., nannies, medical assistants, etc., including those working for mission personnel.

DEPENDS. OKAY: Allowing special-needs applicants to go ahead (best for us to do). FRAUD: Trying to pick a specific officer. MALFEASANCE: An employee is passing an applicant to an “easy” adjudicator, or an officer is picking specific applicants.

You cannot access visa records for personal reasons. You can perform routine tasks on her applications, but you must not give your family members ANY information about their visa refusal adjudications.

It could be appropriate for the Fraud Unit or a consular manager to look up his case for revocation, coordination with law enforcement, or other official purposes; but NOT for personal curiosity.

Could be FRAUD or MALFEASANCE, or both. Applicants lying about non-existent conferences is FRAUD. Other agencies lying about non-existent conferences is MALFEASANCE.
