A teacher has a book of 60 photos of sea creatures. She finds there is a CD-ROM version of the book available for $20. She purchases the CD and posts two of the digital images on her website for students in her class to view. Is she legal?
She is OK probably under the TEACH Act. 1) She can post images in amounts comparable to face-to-face teaching so posting 2 images is fine. 2) The images were already available in digital form (she must have purchased them).

Legal or not legal? A teacher copies one act from a three act play from a legally-acquired copyrighted audio CD and posts it to her Moodle course to view until the end of the Semester? Is the use legal?
Maybe under the TEACH (distance learning) act. 3) A fair use analysis would need to be done to determine is the copying is justified. That fact that it's being used for non-profit purposes (education) is in his favor. The fact that the play is fiction does not. The teacher needs to determine if the portion he's using is small enough and if it would have any reasonable effect on the copyright holder's potential market for the work. If he is posting the audio file online for an online class, and the posting prevents students from downloading the audio file, then the TEACH Act may apply. The TEACH Act allows him to upload a "reasonable and limited" portion of the work so long as it is the smallest amount that can be used for educational purposes and the copyrighted CD is the best reasonably available source for the material.

A teacher purchases a CD-ROM with images and displays seven of them for the class. She also puts them online with an additional 30 photos. She resizes all 37 pictures to thumbnail size so students can browse through on their own time. Is this legal?
Probably OK. The TEACH act does not apply because the images are for students outside of class. Under Fair Use the teacher would need to determine: 1) Who will access the images; 2) How long will they be posted; and How they will be used; and 4) What kind of permissions do you have? Since the CD was purchased there are probably licensing requirements in place that may prohibit posting the images on a website. Posting online would be a violation of contract law and not copyright law.
