91.17b Except in an emergency a pilot cannot allow a person who appears intoxicated or on drugs to be carried except a medical patient under proper care.

Before carrying passengers as pilot in command, what recent experience requirements must a pilot meet?
At least three take-off and landings in category and class aircraft within the preceding 90 days for daytime, for night (1 hour after sunset to 1 hour before sunrise) they must be to a full stop.

91.157b - Clear of clouds, visibility 1sm, and daytime.
