This legal authority exists as part of tribal sovereignty, even where no reservation boundaries were drawn, survives allotment, termination, and relocation, and is strongest where federal recognition arrived last—or not at all. It is invoked in court only indirectly, protected most when unspoken, and understood best by examining what Tribes continued to do after treaties ended rather than what treaties allowed them to do.
