Can police bring patients back?
Yes, RCMP can bring certified patients who abscond back under a directors warrant (form 21)
Is this part of the Mental Health Act?
No. Involuntary medical treatment falls under Section 12 of the Health Care Consent and Care Facility Act
When is it used?
Patient is neglected, self-neglected, or abused and not able to seek support and assistance.
Can RNs co-sign MH forms?
Yes. Found under “Forms” tab on Cerner. Must be co-signed to be active. Learning Hub Module required - PEAT RN/RPN able to do this!
How long are form 4.1 and 4.2 valid?
Form 4.1 = 48 hrs
Form 4.2 = 1 month less a 1 day
When is this used?
The patient is unable to consent due to impairment by substance use, decreased LOC, or incapable of consent with no known or available SDM.
What care can be provided?
Emergent or urgent medical care to preserve the patient’s life, prevent serious harm, or alleviate severe pain.
Where will AGA be documented?
If patient is under AGA it will be written in SW documentation
If necessary: Safety and Alert Plan at front of paper chart, Section 59 (Certificate of Emergency Assistance) form on chart
Can you use restraints?
Yes, if these are required for patient safety or to complete the treatments outlined in Form 5 OR safety reasons due to behavioural emergency
What would override the need for a patient to be held under section 12?
The presence of an advance directive or substitute decision maker (SDM) that can represent the patient. SW consult if unknown SDM!

Will be written in SW documentation if patient is under AGA.

Who can complete a Form 20 in the event a certified patient leaves AMA?
RN/RPN or SW can complete Form 20 if patient absconds
