Yes, this sounds like it would be in line with the Scholar's objectives, field, and in the "spirit of exchange". Procedures must be followed by the RO/ARO to authorize the employment in writing and the Site of Activity must be added to the SEVIS record. In order to authorize the activity the RO/ARO will need: - A letter from the "employer" setting forth the terms and conditions of the offer to lecture or consult including the duration, number of hours, field or subject, amount of compensation, and description of such activity; and - A letter from his or her department head or supervisor recommending such activity and explaining how it would enhance the exchange visitor's program.

An Advisory Opinion is an official judgement from the Department of State to determine if the visa notation indicating whether or not the EV is subject to 212(e) is correct. The Waiver is a request to remove the 212(e) requirement.

Yes, it is. While many schools might have institutional limitations or policies on when Academic Training may begin, there are no clear regulatory restrictions so an EV may be authorized for appropriate Academic Training even after only one month in the program.

The student does not qualify for a simple change of category through upward matriculation (because the non-degree category does not permit this). The student will either need to file for a change in category with the Department of State, or be issued a new DS-2019 (with a new SEVIS number) for a new (Master's or Doctorate) category, travel, and then reenter the US (as long as found otherwise eligible). Similarly, re-entry with an F-1 might be more suitable.

What does the I-94 notation "D/S" stand for and practically speaking, what does it mean for the EV?
D/S = "Duration of Status". It means that the EV can remain in the US for as long as he or she maintains a valid DS-2019 (and is appropriately maintaining status), plus an additional 30 day grace period. Having an I-94 notated with D/S also precludes the EV from having to apply to USCIS for an extension of stay, which is the normal requirement with date-specific I-94 cards.

If the J-1 parent is subject to 212(e) either due to the skills list (which is rather extensive for South Korea) or government funding, then Soo Hyun is also subject. As a result, he would be ineligible for a change of status to F-1 status within the US. You could advise him, however, of the option to travel out of the US to apply for the F-1 visa at a US consulate and then use that F-1 to reenter the US.

The J-2 spouse of a J-1 post-doc at a neighboring institution has been offered a research position of her own at your institution with a one year contract. The J-1 is finishing his research, however, and is returning to his home country to begin a new job. Can the J-2 take the job as a post-doc? Explain.
