Crime Classifications
Refers to a serious a serious crime potentially punishable by one year or more in jail.
What is a Felony?
Drug trafficking, sexual assault, aggravated assault, burglary of a residence, and motor-vehicle DUI involving serious bodily injury.
What is Class B?
Maximum of 30 years in prison.
What is Class A?
A person is guilty of this crime if the person: (a) Intentionally or knowingly causes the death or another human being; (b) Engages in conduct that manifests a depraved indifference to the value of human life and that in fact causes the death of another human being; or (c) Intentionally or knowingly causes another human being to commit suicide by the use of force, duress, or deception.
What is Murder?
Refers to a less serious crime, punishable by less than one year in jail.
What is a Misdemeanor?
Aggravated criminal mischief, perjury, burglary, and felony theft.
What is Class C?
Jail for at least 5 years and a fine of $15,000.
What is Class C?
A person may not be convicted of a crime unless each element of the crime is [BLANK] by the State.
What is Proved Beyond a Reasonable Doubt?
Maine no longer uses the categories felony and misdemeanor. Instead (with the exception of murder) crimes are classified into these five classes.
What are: A, B, C, D, and E?
Felony murder, manslaughter, kidnapping, and gross sexual assault involving a minor under the age of 16.
What is Class A?
Maximum penalty not to exceed 6 months of imprisonment and/or $1000 fine.
What is Class E?
A person who is guilty of murder will receive this sentence.
What is 25 years to life?
By other state standards, these crime classes would be considered felony convictions.
What are Class A, B, and C crimes?
Assault, domestic violence assault, operating under the influence, theft of property valued at $1000-$2000.
What is Class D?
Prison sentences up to 10 years and possible fines up to $20,000.
What is Class B?
A person is guilty of [BLANK] if they cause the death of a human being during the commission of another felony such as: robbery, kidnapping, arson or gross sexual assault.

By other state standards, these crime classes would be considered misdemeanor convictions.
What is Class D and E crimes?
Disorderly conduct, operating after suspension, theft of property valued less than $1000.
What is Class E?
Maximum penalty of up to 364 days (less than one year) of jail and a fine up to $2000.
What is Class D?
These violations are not criminal offenses. They are enforceable by the Attorney General, the Attorney General's representative, or any other appropriate public official, to recover the designated fine or impose the appropriate penalty.
