What is a "public forum?"

Where your right to protest is the strongest. A public forum is a location generally open to the public such as streets, sidewalks, and parks. You also likely have the right to speak out on other public property, like plazas in front of government buildings, as long as you are not blocking access to the government building or interfering with other purposes the property was designed for.

NO. testing is open to all ages. You also have the right to privacy, so you do not need your parents permission. Just remember that if you use your parents insurance, it will show up in their statement.

What is the difference between being detained and being arrested?

"Arrested" means you have been taken into custody and can't leave. You can be "detained" for a short period of time if a police officer or other person believes you may be involved in a crime. If you are neither arrested or detained, you have the right to leave/walk away.

If detained by ICE, will the government provide you a lawyer?

NO. If you are detained by ICE, you have the right to consult with a lawyer, but the government is not required to provide one for you. You can ask for a list of free or low-cost alternatives.

What places may require a permit to protest? 

These include a march or parade that requires blocking traffic or street closure; a large rally requiring the use of sound amplifying devices; or a rally over a certain size at most parks or plazas.

No. Schools must let you make up work outside of class or find a way to accommodate your needs.

When can Police search your car without a warrant?

  1. You have given the officer consent;
  2. The officer has probable cause to believe there is evidence of a crime in your vehicle;
  3. The officer reasonably believes a search is necessary for their own protection (a hidden weapon, for example); and
  4. You have been arrested and the search is related to that arrest (such as a search for illegal drugs)

Name a two rights if police or ICE come to your home.

-You have the right to remain silent, even if officer has a warrant.

-You do not have to let police or immigration agents into your home unless they have certain kinds of warrants.

-If police have an arrest warrant, they are legally allowed to enter the home of the person on the warrant if they believe that person is inside. But a warrant of removal/deportation (Form I-205) does not allow officers to enter a home without consent.

Do counter-demonstrators have free speech rights?

Yes. Although counter-demonstrators should not be allowed to physically disrupt the event they are protesting, they do have the right to be present and to voice their displeasure. Police are permitted to keep two antagonistic groups separated but should allow them to be within the general vicinity of one another.

Can teachers search student lockers anytime they like?

YES. In general, if your school district notifies you that lockers are school property and subject to search, school officials are legally permitted to search lockers whenever they deem necessary.

What are warrants and what should they say?

A warrant is a piece of paper signed by a judge giving law enforcement officers permission to make an arrest or to enter a home or other building to do a search. It marks the items that they can search or take. If there is no warrant, you do not have to consent to a search.

What should you ask law enforcement or immigration agents if they show up at your door?

-Ask if they are immigration agents and what they are there for.

-Ask the agent or officer to show you a badge or identification through the window or peephole.

-Ask if they have a warrant signed by a judge. If they say they do, ask them to slide it under the door or hold it up to a window so you can inspect it.

What should you do if you feel your rights have been violated?

-When you can, write down everything you remember, including the officers’ badge and patrol car numbers and the agency they work for.

-Get contact information for witnesses.

-Take photographs of any injuries.

-Once you have all of this information, you can file a written complaint with the agency’s internal affairs division or civilian complaint board.
