By the Gun Court Act 1974 the Parliament of Jamaica established a new court, the Gun Court, to try “firearms offences.” The Act provided for three divisions of the court; the Circuit Court Division and the Resident Magistrate’s Division, constituted by a Supreme Court judge and a resident magistrate respectively, and the Full Court Division constituted by three resident magistrates. Section 8 prescribed a mandatory sentence of detention at hard labour during the Governor-General’s pleasure for specified offences, determinable only by the Governor-General on the advice of the Review Board. The appellants, who had all incurred the mandatory sentence under s.8, sought to argue that the provisions of the Act under which they were tried and sentence were inconsistent with the Jamaican Constitution.

In this Trinidad and Tobago case,

The appellants contended that the right given by s.10 (2) of the Industrial Stabilization Act to a public officer to enter the business premises of a trade union infringed the right of the individual to privacy. The application was dismissed. An appeal was also dismissed, [reported as 12 WIR 5]. The Privy Council lordships think that a trade union in Trinidad appears to be simply an unincorporated society, and each individual member may be said therefore to be affected by the power which s.10(2) originally gave to the Attorney General. But since this power has now been taken away, no further discussion on this point seems to be called for. [

The defendant was the director of a company, which published regular magazines for distribution. Inside the magazines, there was a page that had columns to advertise homosexual practices. It was concluded that this information encouraged males to meet up and engage in homosexual activity. The defendant was convicted for conspiracy to corrupt public morals.

Issues

The defendant appealed his conviction for conspiracy to corrupt public morals. This was on the issue of whether there was an offence of conspiracy to corrupt public morals recognized by the law of England and if he could be convicted of such an offence.

Decision/Outcome

The appeal was dismissed and the conviction was upheld. The law does recognise conspiracy to corrupt public morals as an offence, as this was created by Shaw v DPP and this was to be followed. This case established that the courts has a duty to protect society’s morals and can enforce their own decisions. Lord Reid commented that he did not agree with the Shaw v DPPverdict and he had dissented in that case, but he also did not wish to reconsider this decision now. He stated that while decisions are not always binding on other courts, there is a need for certainty in the law that means not every disagreeable decision should be reversed. The courts now have no power to create new criminal offences and can only be created by Parliament.
