Intro to Law
You must have a basic understanding of....
federal, state, and local laws in order to act properly and effectivly without infringing on individual rights.
What is administrative law ?
The body of law that establishes the operations and procedures of governmental agencies.
What is the articles of the constitution?
Their purpose is to form a contract between the people of the United States and the legislative, executive, and judicial branch.
What is the fifth amendment?
Best known for prohibiting compelled self-incrimination
What is the sixth amendment?
The right to a speedy and public trial, the right to a fair jury, the right to an attorney, the right to be informed of the nature of the charges, and the right to confront witnesses.
What is supremacy clause ?
U.S. Constitution states that when laws conflict, federal law generslly overrules state and local law. State law can be more restrictive then fedral law, but it cannot undermine the federal standard.
What is case law ?
The body of law formed by the decision of the court system, which is part of the judicial branch.
Which amendments are particular important to law enforcement?
First, Second, Fourth, Fifth, Sixth, Eighth, and Fourteenth
What is due process?
Laws must be applied fairly and equally to all people, including a person accused of a crime.
What is the eighth amendment?
Prohibits excessive bails, fines, and cruel and unusual punishment.
What is Statutory law ?
Written law enacted by Congress, state legislatures, or local governing authorites in response to a perceived need; it includes criminal, civil, administrative, and regulatory law.
What is an appellate court?
Responsible for hearing and reviewing appeals from cases that have already been heard in a lower court.
What is the First amendment?
Protects the freedom of speech, press, peaceful assembly, and religion
What are the two main types of due process ?
Substantive due process and Procedural due process
What is the fourteenth amendment?
Expands the application of the Bill of Rights to state and local governments as well.
What is criminal law?
Identifies behavior deemed unacceptable by society; it also sets punishments for those behaviors.
What are the three sources of laws and their role ?
Legislative branch- creates laws
Executive branch- enforces laws
Judicial branch- interperts laws
What is the second amendment?
Guarantees the right to bear arms.
What is Substantive due process?
Fair and consistent enforcement of the law. This means that people are treated fairly.
What is the main focus of a police officer?
Preservation of life
Laws enacted by a municipal(city) or county government.
What do our laws protect?
Our rights, freedom, and lives, and serve to maintian order, protect ownership of property, regulate certain businessess, and raise money for state and federal government.
What is the fourth amendment?
Prohibits unreasonable search and seizure and may require a warrant signed by an independent magistrate(judge).
What is procedural due process?
Procedures that must be followed to protect a persons right during a criminal justice process. This means that everyone is entitled to every step in the criminal justice process.
