3.3.5 Academic Educational Services

Care providers must conduct an educational assessment within 72-hours of an unaccompanied alien child’s admission into the facility in order to determine the academic level of the child and any particular needs they may have. Care providers must provide educational services based on the individual academic development, literacy level, and linguistic ability of each unaccompanied alien child

2.4.2 Home Study Requirement

ORR Mandated Home Studies

ORR requires a home study before releasing any child to a sponsor in the following circumstances:

  1. The potential sponsor is seeking to concurrently sponsor two (2) or more children (regardless of whether the potential sponsor has previously sponsored or sought to sponsor a child) and at least one (1) of the children is unrelated to the potential sponsor;
  2. The potential sponsor has previously been the sponsor of two (2) or more children and is now seeking to sponsor one (1) or more additional children (regardless of whether the previous or current children are related to the potential sponsor); or
  3. The potential sponsor is seeking to sponsor an unrelated child who is 12 years or under.

3.7.1 Know Your Rights Presentation & Confidential Legal Consultation for Legal Relief

Children in ORR legal custody receive a Know Your Rights (KYR) presentation (in-person, telephonic, or video presentation) within ten (10) business days of admission to an ORR care provider facility9, within ten (10) business days of a child’s transfer to ORR facility (except ORR Long-Term Foster Care or ORR Transitional Foster Care), and every six (6) months for unrepresented children who remain in ORR custody, as practicable.
