No, there were no specific issues or disagreements with The Arc US or The Arc Maryland. We will continue to support and advocate alongside them on behalf of and with people with disabilities!

Can a support broker terminate the employee of a Participant?

No - A separation can only occur when authorization is granted by the participant employer or their authorized  representative/guardian that we have documentation on file for. They have final choice.

Is a Designated Representative a paid position? 

No - A Designated Representative is an unpaid position, and that the acceptance of this position will prohibit this representative from working in a paid capacity under any waiver service category. 

*If this designated representative is a relative (i.e., my parent, stepparent or sibling) no other relative (parent, stepparent or sibling) can work as paid staff under self-direction, per the rules outlined in DDA’s waiver programs.

*For example, in a situation where a legal guardian or family member are serving as paid staff to a participant, another team member can be tasked to assure that the services being provided meet the participant’s desires and interests.

Can a Participant move forward with onboarding an applicant if HITS are returned in their BGC results?

Yes - a participant may choose to move forward with an applicant.  However it is DDA's final decision as to whether that applicant will be hired to support the participant. 

*DDA approval must be on file within the Applicant's folder.

This would be the team's discretion. We are able to advise them on what their options are, but we can not make the choice for them.
