Difference between presumptive and determinate sentences.
Presumptive- The severity of the offense (listed as 1-11 on the left) and severity of the suspect’s criminal history (letters A – I at the top) intersect at the presumptive sentence.
For example, a person who assaults a public safety officer (level 6), who has three prior assault felonies (level A) would be presumed to be sentenced to 25-30 months in the Dept. of Corrections (DOC).
Determinate- Some statutes prescribe the sentence if the person is convicted. The most common set of crimes with determinate sentences are commonly referred to as “Measure 11” offenses.
These sentences were enacted by a voter initiative of the same number and can be found in ORS 137.700 – 712. Most of these offenses are major person crimes (e.g., manslaughter, rape, and sodomy). When convicted, the person must be sentenced to the mandatory minimum (day-for-day) in DOC.
An inmate tells the deputy working his post that he wants to see medical for a "real bad earache" and touches his ear. He pulls his fingers away to show the deputy a clear liquid on his fingers and the deputy working that post brushes it off. He tells the inmate that he will let someone know but never does. The man is taken to the hospital a week later and is found to have a chronic ear infection. He could have lost his hearing and the inmate states that he wants to sue.
