What is PDD?
Per the CO DMV Webpage:
Legislation, effective January 1, 2014, has significantly changed previous law involving alcohol violations, Persistent Drunk Drivers (PDD) and the Ignition Interlock program. Those changes include:
The reduction of the Blood Alcohol Content (BAC) on a chemical test from 0.17 to 0.15 to designate the driver as a Persistent Drunk Driver.
The refusal of a chemical test at a traffic stop on or after, January 1, 2014, will now result in a Persistent Drunk Driver designation.
If a driver refused a chemical test prior to January 1, 2014, and was previously ineligible to reinstate early with Interlock, they may now either finish serving the remainder of their revocation and reinstate with full driving privileges, or serve at least two months and apply for early reinstatement with Interlock for one year. They are not eligible for Financial Assistance in this case.
If a driver has multiple alcohol violations or refusals on their record, the wait time for early reinstatement with Interlock has been reduced to up to two months.

Am I eligible for early reinstatement?
per DMVcolorado.gov:
Early reinstatement is limited to drivers who:
- Are residents of Colorado
- Are 21 years of age or older at the time of the violation
- Have satisfied all reinstatement requirements (other than time)
Reinstatements for violations before January 1, 2023
- Have a Per Se* or DUI conviction and have already served one month for the alcohol related restraint, or
- Have a Refusal of a BAC test and have already served two months for the alcohol related restraint
- Have a Per Se or DUI conviction are eligible on the first day the revocation action goes active (no one month waiting period)

- Have a Per Se or DUI conviction are eligible on the first day the revocation action goes active (no one month waiting period)

Drivers wishing to know if they are eligible to participate in the Interlock program should call Driver Services at 303-205-5613 to inquire about early reinstatement.
*§ 42-4-1300.3.(3) C.R.S. defines "DUI per se" as meaning "driving with a BAC of 0.08 or more, and use of the term shall incorporate by reference the offense described in section 42-4-1301(2)(a)."

What was the number one drug use violation reported by the Clearinghouse in 2021?
Per Clearinghouse Monthly Report;
The largest number of positive driver test results were for marijuana, which increased to 31,085 in 2021, up from 29,511 the prior year. Positive marijuana test results totaled more than 55% of all driver drug test failures.
The number of positive cocaine test results also increased, to 8,765 for all of 2021, from 7,940 the prior year.
Positive drug test numbers slightly declined for 11 of 12 other drug test categories.

Why has my license been revoked for 5 years?
Per the CO DMV Webpage: If you are a Habitual Traffic Offender and you have been convicted of 3 "qualifying offenses" which occurred over a 7 year period of time (based on date of violation, not conviction), your license will be revoked for 5 years.
"Qualifying offenses" include, but are not limited to:
Driving under suspension or revocation
Driving while ability impaired (DWAI)
Driving under the influence (DUI)
Reckless driving
Vehicular assault

*Only by committing oneself fully to the program of AA – making meetings, working the steps and, after completing the program, finishing the steps, helping others, and maintaining active recovery and participation – can one assess the true success of the program.
No one would enroll in a course to learn CPR and expect it to be successful if they never showed up, weren’t paying attention or didn’t participate in the activities. Why do we hold programs like Alcoholics Anonymous to a different standard? In order to succeed in a program of any kind, you actually need to do it.

Is Financial Assistance for Ignition Interlock available?
Yes, it may be available to you.
The Department of Revenue administers an account established to provide financial assistance for first-time offenders installing an ignition interlock device or those designated as persistent drunk drivers completing their initial installation on or after January 1, 2014, who are unable to pay the full costs of the device. If you qualify for assistance and funds are available, the Department may pay for a portion of your interlock device cost. Other restrictions and conditions may apply.
Eligibility is determined at the time of your interlock installation and following criteria apply:
You are either a first-time offender with a violation date on or after January 1, 2009 or have been designated as a persistent drunk driver completing your initial interlock installation on or after January 1, 2014.
You are Lawfully Present in the U.S. and a Colorado resident.
You were an adult driver (21 years of age) at the time of the violation.
Your Federal Adjusted Gross Income (FAGI) on the State of Colorado tax file falls within a predetermined percentage of the current year Poverty Guidelines established by Health and Human Services.
Any subsequent suspension or revocation of your driving privileges will terminate financial assistance.
