Qualified or Competent person on site -This is the one with authority to correct and or eliminate hazards. 

What is a competent person? 

CP focuses on hazards. They have demonstrated their ability to identify existing and potential hazards in the workplace. They know which conditions can be considered unsanitary or dangerous to employees. While a qualified person may have more technical expertise and also be able to recognize hazards, a competent person has the authority to correct or eliminate them.

while OSHA enforces regulatory standards they must adhere to what guidelines the manufacturer of a product releases. If a manufacturer states its guidelines for recommended use and you are not using it for that purpose while performing your work OSHA could step in to prevent that.  Example using a wrench as a hammer or self made tools being used that are not safe.
