Alternating Thursdays. Contact FRS team or look at FRS Judicial Calendar. If Judge Smith is going to be out of town, court may be held on a different day.

What happens to the Judicial Assignment and District Office when a juvenile is ordered into BHC or RC and who makes this change? 

Judge Smith is added as the Specialty Judge and the Primary Judge. The District Office will be changed to Spanish Fork. Both of these things will be done by Judge Smith's team.

Where is staffing held and who is involved? 

It's held in the Provo conference room on the 4th floor.

Therapists, attorneys, probation officers, JA, and Judge Smith.

Judge, Probation officers, Therapists and Attorneys

All participants and their parents/guardians stay for the duration of court to support the other participants.

Judge Smith's team will add the attorneys as a Case Attorney once the juvenile is accepted into Behavioral Health Court or Recovery Court

What type of treatment is provided? 

Therapy, groups, drug testing (RC), court every two weeks with immediate sanctions and/or incentives, probation monitoring, and a team rooting for you.

What qualifies a juvenile for Recovery Court? 

- Youth needs to be Mod/High Risk

- Drug related charges

- Substance abuse evaluation recommending IOP

When is the 4behavecourt, 4behavepass, and 4behavefail quickwords used? 

4behavecourt- when the juvenile is ordered to participate in BHC by Judge Smith.

4behavepass- when a juvenile has successfully completed BHC.

4behavefail- when a juvenile fails and is terminated from BHC. 

These are entered by the JA covering the BHC hearing.

What time do we set an Arraignment/Pretrial for a new participant coming into Specialty Court? 

Thursday at 3:15 p.m. 

If there is more than one juvenile coming into court, contact the FRS team.

What kind of sanctions are given for non compliance? 

Work crew, community service, detention, an essay, and/or a presentation.

What happens after successful completion of Specialty Court? 

Delayed entry is entered successful

Allegations are dismissed. 

A Graduation is held with Judge Smith presenting the juvenile with a certificate and everyone gets cookies. 

A review hearing is set 30 days later, then they are released.

What qualifies a juvenile for Behavioral Health Court? 

- Youth needs to be Mod/High Risk

- Must have a mental health diagnosis that appears to be the driving force behind delinquent behavior. 

- Needs a screening done by Wasatch Behavioral.

What is the process if a hearing is set with the home Judge, but probation would like the juvenile set with Judge Smith for Specialty Court? 

Probation will need to file an R&R with the home Judge and upon signature of the order by the home Judge the order should be sent to 4thjuvsmith@utcourts.gov for scheduling.

What happens if a juvenile who has graduated specialty court gets new charges? 

Ask FRS if he would like the case back (if it's not in his zip code) or if he would like the home Judge to handle the case.
