Under Policy 430, at what point is an officer required to activate their body-worn camera on a call for service?

Prior to, or upon, arrival at any call for service — including self-initiated activity

Two qualifiers that go with it:

  • At no time is an employee expected to jeopardize his/her safety in order to activate a BWC
  • Officers working special events — the policy names the Sonoma County Fair and Wednesday Night Market — are not required to activate unless engaging in enforcement activity during the event

You lawfully detain someone on a burglary call and pat him down for weapons. You feel a small, soft lump in his front pants pocket. You know it isn't a weapon, but based on your training and experience you suspect it's narcotics — so you squeeze it between your fingers to confirm, decide it's a baggie of dope, reach in, and pull it out. You're right.

Is the seizure good?

  • Not good. Minnesota v. Dickerson (1993)
  • The deciding act is the squeeze. The instant you determined it wasn't a weapon, the lawful purpose of the weapons pat-down was finished. Squeezing to figure out what it was converted a weapons pat-down into an evidentiary search — and you had no authority for a search
  • Plain feel requires the incriminating nature be immediately apparent from the initial pat-down. If you need to squeeze, roll, or probe to identify it, by definition it wasn't immediately apparent
  • Being right doesn't save it. Legality is judged on what you knew at the moment you acted, not on what you found. And "training and experience" doesn't license the extra squeeze — it only matters if it let you recognize the item on first contact

What is a Ramey warrant, and what does it let you do that you couldn't do without one?

A Ramey warrant is a California arrest warrant signed by a magistrate based on a sworn declaration of probable cause — obtained before any criminal complaint has been filed by the DA. It allows officers to enter a residence to arrest a suspect, which they otherwise could not do absent consent or exigent circumstances.

The name comes from People v. Ramey (1976) 16 Cal.3d 263, and the mechanism is codified at Penal Code § 817.

Through their iPad, parents find out that their 13-year-old girl has been sending illicit selfies to an adult male with her iPhone, which only she uses. The daughter refuses to cooperate and says she does not want her iPhone searched. The parents gave you the phone.

What are you going to do?

• Yes — CalECPA applies: the iPhone is an “electronic device” — PC 1546(f)

• Consent does not get you in

• The daughter is the authorized possessor and refused

• Owner / parent consent is not sufficient to override the daughter’s right to privacy

• No qualifying exigency — no danger of death or serious physical injury

• Yes — get a search warrant — PC 1546.1(b)–(c);

• Seizing to preserve is lawful; searching the contents is not

• Isolate, keep power state as found, document, chain of custody

• Parental consent alone invites suppression — PC 1546.4

You knock on a door for a loud party call. The resident steps outside and consents to you searching the living room. While you're in there, you see a baggie of suspected cocaine sitting out on the coffee table. The resident immediately says, "Okay, that's enough — get out."

Can you seize the cocaine? And what can you do next?

  • Yes — seize the cocaine. You were lawfully present when you saw it and its incriminating nature was immediately apparent. That's plain view. Revoking consent does not erase what you already lawfully observed
  • Consent is over going forward — stop searching. No bedrooms, no other rooms, no "one more look around"
  • You now have probable cause. Options: arrest if you can tie possession to a person, secure/freeze the scene and get a search warrant for the rest of the residence, or act on a true exigency (someone actively destroying evidence) — but don't manufacture one (Segura v. United States, 1984; Illinois v. McArthur, 2001)
