I didn't receive my EIP3, online account shows that i did, i started a PT and I already filed my taxes, but still didn't receive my return or my EIP3 what's the next step?

If a trace is initiated and it is determined you did not receive the third payment, the IRS will update your account to indicate you did not receive the third payment, but the IRS cannot reissue your payment. Instead, you must claim the 2021 Recovery Rebate Credit on your 2021 tax return if eligible. If you already filed your 2021 tax return and the trace is complete confirming that you did not receive the third payment, the IRS will adjust your 2021 Recovery Rebate Credit even if you entered $0 on line 30 or left it blank. After your 2021 Recovery Rebate Credit is adjusted, you will be sent a check for any overpayment and a letter explaining the change.

(Divorced Callers)

I filed MFJ in 2020 and will now be filing on my own. What amount do I put on my taxes for the amount received in advctc payments.

Callers who are filing single on the 2021 return should only include the amount listed on their Letter 6419 or shown in their own Online account. • If the caller states they did not receive the amount listed on their Letter 6419 because it went to an account, they no longer have access to, you may Transfer the caller to the IRS per our AdvCTC Transfer Job Aid path “Issued but not received/returned by post office/rejected by bank or reports payment was lost/stolen or destroyed.” • If the caller gave their payments to their ex-spouse and now do not understand why they have to list their amount as received on their tax return should be read FS 2021 CTC FAQ C3. You may then kindly explain to the caller since the payments were issued to them, they will be required to report them on their tax return.

Credit Delivery: How and when can I expect to get my 2021 credit?

If you didn’t qualify for the third Economic Impact Payment or did not receive the full amount, you may be eligible to claim the 2021 Recovery Rebate Credit based on your 2021 tax information.

If you are eligible for the 2021 Recovery Rebate Credit, the credit amount will reduce the amount of tax you owe for 2021. Generally, if the Recovery Rebate Credit amount is more than the tax you owe, it will be included as part of your 2021 tax refund.

You will receive your 2021 Recovery Rebate Credit included in your refund after your 2021 tax return is processed. If you requested a trace of any third Economic Impact Payment and the trace confirms you did not receive the payment, the IRS will adjust the amount of 2021 Recovery Rebate Credit claimed on your 2021 tax return and will send any overpayment.

If your income is $73,000 or less, you can file your federal tax return electronically for free through the IRS Free File Program. The fastest way to get your tax refund is to file electronically and have it direct deposited, contactless and free, into your financial account. You can have your refund direct deposited into your bank account, prepaid debit card or mobile app and will need to provide routing and account numbers.

You can check the status of your refund under Where’s My Refund? Generally, you will receive your refund within 3 weeks if you file electronically. If you mail your return you should check the IRS Operations page for updates on processing times. If the IRS identifies an error in your calculation for this (or anything else reported on your return), it could cause a delay while we make any necessary corrections.

How were my advance Child Tax Credit payment amounts determined?

The IRS determined your advance Child Tax Credit payment amounts by estimating the amount of the Child Tax Credit that you will be eligible to claim on your 2021 tax return during the 2022 tax filing season.

Our estimate of your 2021 Child Tax Credit was based on information shown on your processed 2020 tax return (including information you entered in the Child Tax Credit Non-filer Sign-up Tool in 2021). If we had not processed your 2020 tax return when we determined the amount of your advance Child Tax Credit payment for any month starting July 2021, we estimated the amount of your 2021 Child Tax Credit based on information shown on your 2019 tax return (including information you entered into the Non-Filer tool on IRS.gov in 2020). If we processed your 2020 return, we recalculated your advance Child Tax Credit payments and adjusted any remaining monthly payments.

Disbursement of advance Child Tax Credit payments began in July and continued on a monthly basis through December 2021, generally based on the information contained in your 2019 or 2020 federal income tax return.  If you are eligible for the Child Tax Credit, but did not receive advance Child Tax Credit payments, you can claim the full credit amount when you file your 2021 tax return during the 2022 tax filing season.

Note: Advance Child Tax Credit payment amounts do not include the $500 Credit for Other Dependents, which is not refundable. For more information about the Credit for Other Dependents, see Schedule 8812 (Form 1040), Credits for Qualifying Children and Other Dependents.

Tax Return Processing: Will it take longer to process my 2021 tax return if I claim the credit?

Claiming the 2021 Recovery Rebate Credit on your tax return will not delay the processing of your tax return. However, it is important that you claim the correct amount. If you claim the 2021 Recovery Rebate Credit on line 30 and miscalculate the amount of credit you are eligible to receive, the IRS will adjust your return and send a notice explaining the changes made. If you are due a refund it may be delayed while we make any necessary corrections.

To figure the credit amount, you will need to know the amount(s) of any third Economic Impact Payments you received. Log into your online account to find your third Economic Impact Payment amounts. You may also refer to Notice 1444-C, Your Third Economic Impact Payment, which shows the amount of the third payment.  In February and March 2022, we sent Letter 6475 confirming the total amount of the third Economic Impact Payment and any plus-up payments you received in 2021. See: Where can I find the amount of my Third Economic Impact Payment?

The fastest and most accurate way to get your tax refund is to file electronically where the tax preparation software will help you figure your Recovery Rebate Credit. Visit IRS.gov/filing for details about IRS Free File, Free File Fillable Forms, free VITA or TCE tax preparation sites in your community or finding a trusted tax professional. The Recovery Rebate Credit Worksheet in the 2021 Form 1040 and Form 1040-SR instructions can also help determine if you are eligible for the credit.

Your 2021 Recovery Rebate Credit will reduce any tax you owe for 2021 or be included in your tax refund.

What if I will claim a child on my 2021 tax return but did not claim that child on my 2020 tax return?

Your advance Child Tax Credit payments were based on the children you claimed for the Child Tax Credit on your 2020 tax return (or 2019 tax return, if your 2020 tax return had not been processed as of the payment determination date for any of your monthly advance Child Tax Credit payments).

If you did not receive advance Child Tax Credit payments for a qualifying child you will claim for 2021, you can claim the full amount of your allowable Child Tax Credit for that child when you file your 2021 tax return during the 2022 tax filing season.

What are the steps to make this a valid transfer if the caller has more questions.

If I didn’t receive the third Economic Impact Payments because a 2019 or 2020 joint return was filed in my name without my consent, can I claim the 2021 Recovery Rebate Credit?

After covering the response provided in the FAQ, if caller has additional questions on this topic, transfer to IRS.

EIP Transfer Job Aid V35.pdf

You may be able to claim the Recovery Rebate Credit if you can establish in writing that the return was signed under duress, your signature was forged, the return was filed without your consent, or you were not legally married at the end of the year on which the third payment was based. We issued the third payments based on information from your 2020 tax return, or, if that wasn’t available, your 2019 return.

To show that you could not resist your spouse’s demands and signed under duress, you can provide written documentation to support your claim that the joint election was invalid. You may submit a separate return for the prior year if you had a filing requirement or provide a statement signed and sworn under penalties of perjury that you didn’t need to file a tax return for the prior year or that the return was filed without your consent
