Annotate this passage below:

Excerpt:

The United States government is divided into three branches: the legislative, executive, and judicial. This system was carefully designed by the Founders to prevent any one person or group from holding too much power. The legislative branch, made up of Congress, creates the laws. The executive branch, led by the President, enforces them. The judicial branch, headed by the Supreme Court, interprets them and decides whether they align with the Constitution.

This balance is known as the separation of powers, and it works alongside a system of checks and balances — meaning each branch has the ability to limit the power of the other two.

Underline: The legislative branch, made up of Congress, creates the laws. The executive branch, led by the President, enforces them. The judicial branch, headed by the Supreme Court, interprets them and decides whether they align with the Constitution.

Read this passage and answer the question using the R.A.C.E.S. strategy:

In 1803, the Supreme Court case Marbury v. Madison established judicial review. This decision was controversial because the Constitution never explicitly grants the Supreme Court the power of judicial review. Critics argued that Marshall essentially claimed a power for the judiciary that the Founders had not clearly defined.

Why is judicial review debated?

There are many reasons why judicial review is debated. Judicial review is debate because Constitution does not specifically grant the Supreme Court the right to judicial review. The text states, " the decision was controversial because the Constitution never explicitly grants the Supreme Court the power of judicial review." This shows that judicial review is debated due to the Constitution allows the Supreme Court to do.
