What is "symbolic speech?"
government censorship of information before it is published or broadcast
What is prior restraint?
SCOTUS said that symbolic speech is protected on school grounds.
What is Tinker v. Des Moines?
This guarantees that you can have a fair trial.
What is the 6th Amendment?
The case that involved flyers that proclaimed that the military draft violated the 13th Amendment.
What Schenck v US (1919)?
The law should not punish speech unless there was a clear and present danger of producing harmful actions
What is the clear and present danger test?
The conditions of free speech restriction.
What are defamatory/obscene speech and speech that incites violence and/or lawbreaking?
It says you can't be stopped from practicing whatever religion you want to practice.
What is the Free Exercise Clause?
The five freedoms in the 1st Amendment.
What are Religion, Assembly, Press, Petition, Speech (RAPPS)?
This case involved a magazine parody and a public religious/political leader.
What was Hustler v. Falwell (1988)?
Legal rights that protect individuals from discrimination.
What are civil rights?
This case involved a jacket that read "F--- the Draft. Stop the War!"
What was Cohen v. California (1971)?
It says you can't be forced to practice a certain religion.
What is the Establishment Clause?
Applying the Bill of Rights to state law
What is selective incorporation?
The body that is responsible for interpreting the Bill of Rights.
Who is the Judicial Branch (Supreme Court)?
Furman v. Georgia and Gregg v. Georgia deal with the protections in this amendment.
What is the 8th amendment?
The standard to determine obscene speech.
What is the Miller Test?
The court "test" used to determine if an act is protected under freedom of expression.
What is the Time, Place, and Manner Test?
North Carolina and Rhode Island.
