As a Mandated Reporter, who's responsibility is it to report maltreatment of a minor to child protection?
The person who witnesses it or suspects. If you work with children in a licensed facility you are legally required or mandated to report and cannot shift the responsibility of reporting to your supervisor or to anyone else at your licensed facility.

Who is considered a Vulnerable Adult?
Any person 18 years of age or older who: Categorical: 1. is a resident or in-patient of a facility 2. receives services at or from a facility required to be licensed to serve adults (MS245 A.01, MS245A.15) 3. Receives services from a home care provider required to be licensed under (MS 144A.46) or from a person or organization that exclusively offers, provides, or arranges for personal care assistant services under the Medical Assistance program. Functional: 1. Regardless of residence or whether any type of service is received possess a physical or mental infirmity or other physical, mental, or emotional disfunction: a. that impairs the individual's ability to provide adequately for the individual's own care without assistance, including the provision of food, shelter, clothing, healthcare or supervision; and b. because of the dysfunction or infirmity and the need for care or services, the individual has an impaired ability to protect the individual's self form maltreatment.

What is financial exploitation?
The misuse of funds, assets or property or the failure to use the vulnerable adult's financial resources to care for the vulnerable adult which results in or is likely to result in detriment to the vulnerable adult.

What is failure to report?
A mandated reporter who negligently or intentionally fails to report is liable for damages caused by the failure. Additionally, an individual may be disqualified from providing direct contact services for failing to make a required report. Facilities that fail to make mandated reports may be subject to a fine.

What are the two types of maltreatment which fall under the MOM act?
Abuse and neglect. Financial exploitation is not considered under this act.

What is theraputic conduct?
The provision of program services, healthcare, or other personal care services done in good faith in the interest of the vulnerable adult by: 1. an individual, facility, or employee or person providing services in a facility under the rights, privilege, and responsibilities conferred by state license, certification or registration; or 2. a caregiver.

What are the consequences for not reporting MOM?
You are guilty of a misdemeanor in addition a mandated reporter who fails to report maltreatment that is found to be serious or recurring maltreatment may be disqualified from employment in positions allowing direct contact with persons receiving services from programs licensed by DHS and by MN Dept of Health and unlicensed personal care provider organizations.
