If a person is heavily intoxicated by alcohol or drugs, they cannot legally give consent. This means any sexual activity that occurs is a crime, regardless of whether the person said 'yes' at the time.

Alcohol makes consent harder to navigate, so if a potential partner has been drinking alcohol it’s up to you to recognise and respect if they’ve had too much to give consent.
